ART Act 2021 compliance checklist

Registration checklist

• Clinic/bank is registered with the National Registry before providing ART services. Act s.15
• Note the registration date: a certificate is valid for five years from grant. Act s.16(6)
• Certificate is displayed at a conspicuous place, showing its validity. Act s.16(7)
• Renewal application is filed on the National Registry portal (Form 1 for clinics, Form 2 for banks) 60 days before expiry. ART Rules r.8A(1) (2026 amendment); earlier r.15.1 (2022) specified Forms 3 & 4
• Renewal fee budgeted: ₹25,000 (Level 1 clinic), ₹1,00,000 (Level 2 clinic), ₹25,000 (ART bank); if filed later than 60 days before expiry, the initial-registration fees apply instead: ₹50,000 / ₹2,00,000 / ₹50,000. Fee note (15 Oct 2026): the original ART Rules 2022 (r.15.3, Tripura HC copy) listed ₹1,00,000 / ₹5,00,000 / ₹1,00,000. The 2026 amendment (G.S.R. 491(E), Gazette No. 440, 17 June 2026) sets the lower figures above. Mint (1 Jul 2026) reports the same. We read the amendment text as reproduced by TaxHeal; we could not yet open the official copy on egazette.gov.in or artsurrogacy.gov.in, whose rules page still lists only the 2022 and 2023 rules. Confirm the current fee on the National Registry portal before paying.

• Old certificates (both copies) are surrendered once renewal or rejection is received. ART Rules 2022, r.15.6
• Know your appeal window: 30 days from a rejection, suspension or cancellation order. Act s.19; Rules r.15.5
